TERMS AND CONDITIONS OF USE
As a Term and Condition of our services you agree that RadioAirplayPros.com and its affiliates makes no representation or warranties in any way regarding the success of any of our client's project. It is fully understood that RadioAirplayPros.com provides a service in which we guarantee a certain number of radio airplay spins on a variety of radio stations that support new and developing recording artists. These radio stations may include major Commercial Terrestrial FM Radio, College Radio, Internet Radio and other forms of radio broadcasting. As a copyright holder, you grant RadioAirplayPros.com the right to submit your music to various radio station programmers, DJs and other music industry professionals. Our guaranteed radio airplay spin count is obtained from a combined number of radio stations that’s listed on our station panels per genre.
As a paying Client, you release RadioAirplayPros.com from all liabilities such as copyright infringement or any other claim by a third-party in connection to the use of the material(s) you submitted to RadioAirplayPros. The Client also warrants and represents that all material(s) submitted is either licensed or created by the Client and no other party has any rights or claims to such material(s).
RadioAirplayPros.com offers a guaranteed radio airplay service and is obligated to meet the airplay spin quota on either a weekly basis or by campaign average spin count upon completion of a project. The airplay spin count is calculated by monitored radio stations that ONLY reports to BDS / Mediabase / DigitalRadioTracker.com. A refund or partial pro-rated refund is given to the Client ONLY if the guaranteed airplay spin count is not obtained by any of these radio airplay monitoring companies. In order to complete the airplay spin quota, a combination of reports from these radio airplay monitoring companies may be necessary at times.
The Client agrees that if a breach of this agreement occurs and RadioAirplayPros.com is brought to litigation in which it is connected to the Client’s song, the Client shall reimburse RadioAirplayPros.com all legal costs and expenses incurred in such suit including reasonable attorney fees.
The laws of the State Of Texas shall govern the validity, performance and enforcement of this agreement. Should either party institute a legal suit or action for enforcement, all proceedings shall take place in Harris County or wherever RadioAirplayPros.com designates.
The Client agrees to the above Terms and Conditions upon its paid submission to our service.
